1. Agreement and operator

These Terms govern access to and purchases from https://alkhubaizi.com.kw/, operated by Al Khubaizi Motorcycles LLC, Shuwaikh Industrial St, Kuwait. By using the Site or placing an order, you agree to these Terms, the Shipping Policy, Privacy Policy and Refund & Return Policy. Mandatory Kuwait consumer rights always prevail over inconsistent wording.

2. Eligibility and account security

You must have legal capacity to contract. Products legally restricted by age or safety rules may be supplied only after required verification. You are responsible for accurate account information, credential security and activity under your account, and must notify us of suspected unauthorised use.

3. Product information and responsible use

We take reasonable care with descriptions, specifications, compatibility, colours, images and stock information, but displays and manufacturer updates may cause minor differences. Customers must read manuals, warnings, sizing and compatibility information and use qualified installers where appropriate. Motorcycle and ATV riding involves inherent risk. Helmets and protective equipment reduce risk but cannot prevent every injury or death. Use products lawfully, wear suitable certified protection and follow manufacturer instructions.

4. Orders and contract formation

An order is an offer to buy. Automatic acknowledgement does not constitute acceptance. A binding sale arises when we confirm acceptance or dispatch the goods, subject to payment approval, stock, verification and law. We may refuse or cancel an order for pricing or description error, suspected fraud, quantity/resale abuse, safety, sanctions, export/import restriction or unavailability. If payment was taken, the affected amount will be refunded.

5. Prices, payment and instalments

Prices are shown in Kuwaiti Dinars unless stated otherwise. The final checkout amount includes disclosed delivery and applicable charges. Payment must be authorised through the methods offered. Instalment or buy-now-pay-later services such as Tabby, Deema, Taly or any similar are separately governed by the provider’s agreement, eligibility and schedule; any provider fees or late consequences are determined by that agreement and applicable law.

6. Promotions

Promotions, vouchers and discount codes are subject to their stated period, stock, eligible products, customer/usage limits and non-combination rules. We may correct misuse or clear error, but will not remove rights already created under mandatory law.

7. Delivery, returns and warranties

Delivery is governed by the Shipping Policy; returns and refunds by the Refund & Return Policy. Product warranties, where offered, are described with the product or warranty documentation. Statutory consumer remedies remain unaffected. Services such as installation may have separate written terms disclosed before purchase.

8. Intellectual property and acceptable use

Site text, branding, graphics, photographs, videos, software and design are owned by or licensed to Al Khubaizi and protected by law. You may use the Site for personal, lawful shopping. You may not copy or exploit content commercially, interfere with security, scrape at scale, introduce malware, impersonate others, submit false information or use the Site unlawfully.

9. Reviews and user content

If you submit a review, image or other content, you confirm it is lawful, accurate, non-infringing and not confidential. You grant us a non-exclusive, worldwide, royalty-free licence to display and use it for operating and promoting the business, subject to privacy law. We may moderate unlawful, abusive, misleading or irrelevant content.

10. Third-party services and links

Payment, delivery, maps, social media and other third-party services may have separate terms and privacy notices. We are not responsible for independent third-party sites or services, except to the extent liability arises under mandatory law or from providers for whom we are legally responsible.

11. Liability

Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer remedies or liability for fraud, wilful misconduct or gross negligence where applicable. To the fullest extent allowed, we are not liable for indirect or consequential business losses arising from consumer use of the Site or products. Any limitation is subject to Kuwait law and does not apply where unlawful.

12. Events beyond control

We are not responsible for delay or failure caused by events beyond reasonable control, including government action, transport disruption, customs delay, cyber incident, natural event, epidemic, conflict or supply interruption. We will take reasonable steps to reduce impact and provide any remedy required by law.

13. Changes, severability and waiver

We may update these Terms prospectively by publishing a new effective date. Terms in force when an order is accepted normally govern that order unless law requires otherwise. If a provision is invalid, the remaining provisions continue. Failure to enforce a right once is not a waiver.

14. Governing law and disputes

These Terms and orders are governed by the laws of the State of Kuwait. The courts of Kuwait have jurisdiction, without limiting a consumer’s right to complain to Kuwait’s Ministry of Commerce and Industry or use any other mandatory forum or remedy. Please contact us first so we can try to resolve the issue promptly.

15. Language and contact
